According to the National Institute on Drug Abuse, there were 2,798 opioid-related overdose deaths­­­ in Florida in 2016.  These deaths were at an alarming rate of 14.4 deaths per 100,000 persons, which is 1.1% higher than the national rate of 13.3 deaths per 100,000 persons.

Over the past several years, Florida has experienced dramatic increase in the number of deaths related to opioid epidemic, particularly among those related to synthetic opioids. In 2016, there were 1,566 synthetic opioid-related deaths compared to 200 in 2013

The State of Florida has a drug free workplace program which regulated employer drug testing.  Employers in the State of Florida who establish this type of drug free workplace program can qualify for a discount on their workman’s compensation insurance premiums.  It is important for an employer to ensure that their State drug free workplace program complies with Florida Statute 440-102. 

It is important to understand that although many States have enacted medical marijuana laws, the drug is still a schedule 1 drug and illegal on the Federal level.  It is recommended that employers implement a written drug free workplace policy and have all applicants and employees review along with acknowledgement of receiving the policy. 

A comprehensive Florida Drug free workplace policy should include:

• Increase productivity
• Reduce accidents
• Decrease costs due to insurance claims.
• All employees will become more aware of the importance of safety in the workplace and will benefit from a safer work environment.
• When an employee incurs a work-related injury, and refuses to take a drug test when requested, the injured employee may forfeit eligibility for workers’ compensation benefits regardless of the cause of the accident.
• An employee who loses a job or is denied employment because of a positive drug/alcohol test, may not qualify for unemployment compensation benefits.

Marijuana Laws in the State of Florida

In 2014, the Florida Legislature passed, and Gov. Rick Scott signed, a bill that attempted to exempt a small percentage of individuals with certain medical disorders and their legal representatives from criminal penalties for using and possessing low-THC cannabis that was ordered for the patients by their physicians. Then, in 2016, the legislature passed a bill intended to improve the law, which would also allow terminally ill patients to access all forms of medical cannabis. The law places very heavy burdens on physicians, arguably forcing them to violate federal law in order to recommend medical marijuana. 

The State of Florida recognizes the following conditions that qualify under this act.

• ALS
• Cancer
• Crohn’s disease
• Chronic nonmalignant pain*
• Epilepsy
• Glaucoma
• HIV/AIDS
• Multiple sclerosis
• Parkinson’s disease
• PTSD
• Seizures
• Terminal illness (patients diagnosed with no more than 12-months to live)
• Other debilitating medical conditions comparable to those enumerated

  *Defined as “pain that is either caused by or originates from a qualifying medical condition”
